HOWARD L. LIEBER

Mr. Lieber practices in both State and Federal courts handling a variety of matters, as well as providing clients advice regarding various issues relating to the warehouse and insurance businesses.  Mr. Lieber is admitted to practice in the State of Illinois, in the United States District Court for the Northern District of Illinois and in the Seventh Circuit Court of Appeals.  Mr. Lieber has successfully tried cases to verdict in Cook County, DuPage County, Will County and McHenry County, Illinois and has successfully handled appeals in both State and Federal Appellate Courts in Illinois.  Mr. Lieber has also served as lead counsel on a number of matters pending in jurisdictions outside of Illinois, including California, Ohio, New York, Texas and Iowa.

Mr. Lieber’s practice includes extensive experience in the area of professional liability defense.  Mr. Lieber has successfully defended, including trial to verdict, a number of professional liability matters in Illinois, among them medical and legal malpractice actions.

Mr. Lieber regularly provides advice to clients, both insured and insurance companies, regarding coverage issues.  Mr. Lieber represents insurance companies in declaratory judgment actions filed on behalf of and against insurers.  Mr. Lieber’s experience in this regard includes providing advice concerning coverage issues under doctors’ and nurses’ professional liability policies, lawyers’ professional liability policies, warehouse legal liability policies, jewelers block policies, construction-related policies, as well as all risk and general liability policies.

Mr. Lieber also has extensive experience handling property loss claims, including defending warehousemen in the context of bailment claims and prosecuting subrogation matters to recover monies paid by insurers.  A notable example of such matters includes a claim brought in Federal Court in Illinois involving an international food manufacturer claiming $30 million in property losses. Mr. Lieber represented the warehouseman storing the food products, and successfully structured its defense by adding third-parties and establishing that construction problems proximately caused the damage.

Mr. Lieber recently succeeded in recovering over $2 million in a warehouse fire subrogation action involving the destruction of four law firms’archived files.  This matter involved the novel concept of placing a monetary value on documents that had not been recreated by the law firms.  Mr. Lieber succeeded in fashioning a valuation theory supported by expert testimony that resulted in a settlement with one defendant in the amount of $1 million and a jury verdict of an additional $1 million against the warehouse storing the valuable papers.

Mr. Lieber also handles various commercial matters for, among others, a national banking institution. He advises corporate clients, including warehousemen. These representations include both litigation and non-litigation matters, such as contracts and property lease reviews, as well as advice regarding corporate operations.

Mr. Lieber received his undergraduate degree from Loyola University of Chicago (B.A. 1980) and his Juris Doctor degree from Loyola University of Chicago Law School in 1983.  Mr. Lieber is a member of the American and Illinois Bar Associations.
